Decedent's Estates

A decedent's estate consists of all property that a deceased person owned in his or her individual name upon death and which does not have a beneficiary designated. Property that a decedent owned in the name of a trust is typically referred to as the "trust estate" rather than the decedent's estate, but sometimes the terms overlap.

Decedent's estates need to be probated through the probate court of the county in which the decedent died. Probate is required regardless of whether the decedent had a will when he or she died.
