WILLS, TRUSTS, POWERS OF ATTORNEY

Wills: A Will does not avoid probate; A will makes probate less costly and less time consuming and also makes it more likely that your wishes will be carried out as expressed in the Will.

Trusts: A properly funded Trust will avoid probate. Trusts are a private and flexible way to carry out your wishes, without court intervention.

Powers of Attorney: There are two types of powers of attorney: 1) Medical Power of Attorney and 2) General Durable Power of Attorney; Both Powers end upon your death but they are helpful during your lifetime in the event that you become incapacitated. A medical power of attorney may preclude the need for a guardian and a general durable power of attorney may preclude the need for a conservator during your lifetime.
